Your rights at work

If you have a mental health problem, it’s important that you are not treated unfairly at work, you have rights and you and your employer should be aware of them.

Discrimination in the workplace is illegal, just in the same way it’s illegal to discriminate for race, gender, age etc it’s illegal to discriminate for reasons of health and if you suffer from a mental illness you are protected under The Equality Act of 2010 on the grounds of disability, that your health problems have an impact and long term effect on your normal day to day activity.

The Act covers all aspects of employment from recruitment to leaving employment, Employers must ensure your health is considered and make adjustments in working practice and the environment to help.

There are a number of organisation that can give you guidance, MIND are fantastic so is the disability law service, if you would like local advice we would recommend contacting a local solicitor through our search facility, select employment law and input your location.
